1 जून, 2020 को आर्थिक मामलों की कैबिनेट कमिटी ने सूक्ष्म, लघु और मध्यम दर्जे के उद्यमों (एमएसएमईज़) की परिभाषा में संशोधन को मंजूरी दी।[1] इस ब्लॉग में हम एमएसएमईज़ की परिभाषा में कैबिनेट द्वारा मंजूर परिवर्तनों पर चर्चा कर रहे हैं और एमएसएमईज़ के वर्गीकरण के लिए इस्तेमाल होने वाले कुछ मानदंडों की समीक्षा कर रहे हैं।
वर्तमान में एमएसएमईज़ को सूक्ष्म, लघु और मध्यम उद्यम विकास एक्ट, 2006 के अंतर्गत परिभाषित किया जाता है।[2] यह एक्ट उन्हें निम्नलिखित के आधार पर सूक्ष्म, लघु और मध्यम दर्जे के उद्यमों में वर्गीकृत करता है: (i) माल की मैन्यूफैक्चरिंग या उत्पादन में संलग्न उद्यमों द्वारा प्लांट और मशीनरी में निवेश, और (ii) सेवाएं प्रदान करने वाले उद्यमों द्वारा उपकरणों में निवेश। कैबिनेट की मंजूरी के बाद निवेश सीमा को बढ़ाया गया है और उद्यमों के वार्षिक टर्नओवर को एमएसएमई के वर्गीकरण के अतिरिक्त मानदंड के रूप में इस्तेमाल किया जाएगा (तालिका 1)।
एमएसएमईज़ की परिभाषा में संशोधन के पूर्व प्रयास
केंद्र सरकार ने दो बार पहले भी एमएसएमईज़ की परिभाषा में संशोधन के प्रयास किए हैं। इससे पहले सरकार ने एमएसएमई विकास (संशोधन) बिल, 2015 को पेश किया था जिसमें एमएसएमईज़ की मैन्यूफैक्चरिंग और सेवाओं के लिए निवेश की सीमा को बढ़ाने का प्रस्ताव था।[3] 2018 में इस बिल को वापस ले लिया गया और दूसरा बिल पेश किया गया। एमएसएमई विकास (संशोधन) बिल, 2018 नामक इस बिल में निम्नलिखित प्रस्तावित था: (i) एमएसएमईज़ के वर्गीकरण के लिए निवेश के बजाय वार्षिक टर्नओवर को मानदंड के रूप में इस्तेमाल करना, (ii) मैन्यूफैक्चरिंग और सेवाओं के बीच के अंतर को समाप्त करना, और (iii) केंद्र सरकार को अधिसूचना के जरिए टर्नओवर की सीमा में संशोधन करने की शक्ति प्रदान करना।[4] 16वीं लोकसभा भंग होने के साथ 2018 का बिल लैप्स हो गया।

विश्व स्तर पर एमएसएमईज़ के वर्गीकरण के मानदंड
हालांकि भारत में अब निवेश और वार्षिक टर्नओवर को एमएसएमईज़ के वर्गीकरण के मानदंड के तौर पर इस्तेमाल किया जाएगा, विश्व के अनेक देश व्यापक स्तर पर कर्मचारियों की संख्या को मानदंड के रूप में प्रयोग करते हैं। एमएसएमईज़ पर भारतीय रिजर्व बैंक की एक्सपर्ट कमिटी (2019) ने अंतरराष्ट्रीय वित्त निगम के एक अध्ययन का हवाला दिया था जिसे 2014 में किया गया था। इस अध्ययन में 155 देशों के विभिन्न संस्थानों की 267 परिभाषाओं का विश्लेषण किया गया था।[5],[6] अध्ययन के अनुसार, अनेक देश एमएसएमईज़ को वर्गीकृत करने के लिए कई मानदंडों का एक साथ इस्तेमाल करते हैं। 92% परिभाषाओं में कर्मचारियों की संख्या को कई मानदंडों में से एक के तौर पर इस्तेमाल किया गया था। जिन अन्य मानदंडों को इस्तेमाल किया गया था, वे थे: (i) टर्नओवर (49%), और (ii) एसेट्स का मूल्य (36%)। 11% परिभाषाओं में वैकल्पिक मानदंडों का इस्तेमाल किया गया था, जैसे: (i) लोन की मात्रा, (ii) वर्षों का अनुभव, और (iii) प्रारंभिक निवेश।

एमएसएमई की परिभाषा के मानदंडों का मूल्यांकन
निवेश: 2006 का एक्ट एमएसएमईज़ को वर्गीकृत करने के लिए प्लांट, मशीनरी और उपकरणों में निवेश का इस्तेमाल करता है। निवेश के मानदंड के साथ कुछ समस्याएं हैं जिनमें निम्नलिखित शामिल हैं:
टर्नओवर: 2018 का बिल निवेश के मानदंड को पूरी तरह से हटाकर, वार्षिक टर्नओवर को एमएसएमईज़ के वर्गीकरण का एकमात्र मानदंड बनाने का प्रयास करता था। स्टैंडिंग कमिटी ने बिल के इस प्रस्ताव को मंजूर किया था कि निवेश के स्थान पर वार्षिक टर्नओवर के मानदंड का इस्तेमाल किया जाए।7 यह कहा गया था कि इससे निवेश के आधार पर वर्गीकरण की कुछ कमियों को दूर किया जा सकता है। हालांकि टर्नओवर आधारित मानदंड के लिए वैरिफिकेशन की भी जरूरत पड़ेगी, कमिटी ने कहा कि जीएसटी नेटवर्क (जीएसटीएन) डेटा इस काम के लिए विश्वसनीय स्रोत के तौर पर इस्तेमाल किया जा सकता है। हालांकि, यह भी कहा गया था कि:7
एक्सपर्ट कमिटी (आरबीआई) ने भी निवेश के स्थान पर वार्षिक टर्नओवर को वर्गीकरण के मानदंड के रूप में इस्तेमाल करने का सुझाव दिया था।5 यह कहा गया था कि टर्नओवर आधारित परिभाषा पारदर्शी, प्रगतिशील है और उसे जीएसटीएन के जरिए लागू करना आसान है। उसने सुझाव भी दिया था कि एमएसएमईज़ की परिभाषा में परिवर्तन की शक्ति कार्यकारिणी को दी जानी चाहिए क्योंकि इससे बदलते आर्थिक परिदृश्यों में बदलाव करने में मदद मिलेगी।
कर्मचारियों की संख्या: स्टैंडिंग कमिटी का कहना था कि भारत जैसे श्रम गहन देश में रोजगार सृजन पर पूरा ध्यान देने की जरूरत है और एमएसएमई क्षेत्र इसके लिए उपयुक्त मंच है।7 यह सुझाव भी दिया गया था कि केंद्र सरकार को एमएसएमई क्षेत्र में काम करने वाले लोगों की संख्या का आकलन करना चाहिए और एमएसएमई को वर्गीकृत करते समय मानदंड के रूप में रोजगार पर विचार करना चाहिए। हालांकि एक्सपर्ट कमिटी (आरबीआई) ने कहा था कि जबकि रोजगार आधारित परिभाषा कुछ देशों में पसंद की जाने वाली एक अतिरिक्त विशेषता है, इस परिभाषा को लागू करने में अनेक समस्याएं आएंगी।5 एमएसएमई मंत्रालय के अनुसार, निम्नलिखित कारणों से रोजगार को मानदंड के रूप में इस्तेमाल करना कठिन है: (i) मौसम और काम की अनौपचारिक प्रकृति जैसे कारण, (ii) निवेश के मानदंड की ही तरह इसके लिए फिजिकल वैरिफिकेशन की जरूरत होगी और इसके साथ अन्य खर्चे जुड़े हुए होते हैं।7
एमएसएमईज़ की संख्या
नेशनल सैंपल सर्वे (2015-16) के अनुसार, देश में लगभग 6.34 करोड़ एमएसएमईज़ हैं। सूक्ष्म उद्यम क्षेत्र में 6.3 करोड़ उद्यम हैं जोकि कुल एमएसएमईज़ की अनुमानित संख्या का 99% से अधिक है। लघु और मध्यम उद्यम क्षेत्र का हिस्सा कुल उद्यमों में क्रमशः 0.52% और 0.01% है। एमएसएमईज़ के वितरण को समझने का दूसरा डेटासेट उद्योग आधार है, जोकि यूनीक आइडेंटिफिकेशन अथॉरिटी ऑफ इंडिया (यूआईडीएआई) द्वारा एमएसएमई उद्यमों को यूनीक आइडेंटिटी के तौर पर दिया जाता है।[8] उद्योग आधार पंजीकरण उद्यमों की स्वघोषणा के आधार पर दिया जाता है। सितंबर 2015 और जून 2020 के दौरान 98.6 लाख उद्यमों का पंजीकरण यूआईडीएआई के साथ किया गया है। इस डेटाबेस के अनुसार, एमएसएमई क्षेत्र में सूक्ष्म, लघु और मध्यम दर्जे के उद्यमों का हिस्सा क्रमशः 87.7%, 11.8% और 0.5% है।

एमएसएमई क्षेत्र में रोजगार
2015-16 में एमएसएमई क्षेत्र में लगभग 11.1 करोड़ लोग काम कर रहे थे। कृषि क्षेत्र के बाद इस क्षेत्र में सबसे अधिक लोग रोजगार प्राप्त हैं। रोजगार प्राप्त व्यक्तियों की सबसे बड़ी संख्या व्यापार गतिविधियों में लगी हुई है (35%), इसके बाद मैन्यूफैक्चरिंग में लगे व्यक्तियों (32%) की संख्या है।

एमएसएमईज़ की परिभाषा में परिवर्तन के प्रभाव
एमएसएमई की परिभाषा में परिवर्तन के कई नतीजे हो सकते हैं। जैसे लघु उद्यम के रूप में वर्गीकृत अनेक उद्यम, सूक्ष्म उद्यम के रूप में वर्गीकृत हो जाएंगे, और मध्यम उद्यम के रूप में वर्गीकृत उद्यम, लघु के रूप में। इसके अतिरिक्त अनेक उद्यम जो फिलहाल एमएसएमईज़ के रूप में वर्गीकृत नहीं हैं, नई परिभाषा के कारण एमएसएमई क्षेत्र के अंतर्गत आ जाएंगे। इन उद्यमों को एमएसएमई से संबंधित योजनाओं का भी लाभ मिलेगा। एमएसएमई मंत्रालय निम्नलिखित के लिए विभिन्न योजनाएं चलाता है: (i) एमएसएमई के लिए ऋण, (ii) टेक्नोलॉजी अपग्रेड और आधुनिकीकरण के लिए सहयोग, (iii) उद्यमशीलता और दक्षता विकास, और (iv) क्लस्टर वार उपाय ताकि एमएसएमई इकाइयों में क्षमता निर्माण और सशक्तीकरण को बढ़ावा दिया जा सके। जैसे सूक्ष्म और लघु उद्यमों के लिए क्रेडिट गारंटी फंड स्कीम के अंतर्गत सूक्ष्म एवं लघु उद्यमों को अधिकतम 75% तक क्रेडिट गारंटी कवर दिया जाता है।[9] इसलिए नए सिरे से वर्गीकरण करने से एमएसएमई क्षेत्र के लिए बजटीय आबंटन में काफी बढ़ोतरी की जरूरत होगी।
कोविड-19 के परिणामस्वरूप एमएसएमई से संबंधित अन्य घोषणाएं
2017-18 में कुल मैन्यूफैक्चरिंग आउटपुट में एमएसएमई क्षेत्र का हिस्सा लगभग 33.4% था।[10] इसी वर्ष देश के कुल निर्यात में एमएसएमई का हिस्सा लगभग 49% था। 2015 और 2017 के दौरान जीडीपी में इस क्षेत्र का योगदान करीब 30% था। कोविड-19 के परिणामस्वरूप देश भर में लॉकडाउन के कारण एमएसएमई सहित व्यापार जगत को काफी नुकसान हुआ। इस क्षेत्र को तत्काल राहत पहुंचाने के लिए सरकार ने मई 2020 में अनेक उपायों की घोषणा की।[11] इनमें निम्नलिखित शामिल हैं: (i) 25 करोड़ रुपए तक के बकाये और 100 करोड़ रुपए तक के टर्नओवर वाले एमएसएमईज़ को कोलेट्रल मुक्त लोन, (ii) स्ट्रेस्ड एमएसएमईज़ को 20,000 करोड़ रुपए अधीनस्थ ऋण के रूप में, और (iii) एमएसएमईज़ में 50,000 करोड़ रुपए का कैपिटल इनफ्यूजन। इन उपायों को केंद्रीय कैबिनेट ने मंजूर कर दिया है।[12]

Mr. Ramnath Kovind completes his tenure as President in July. With the Election Commission of India expected to notify the election dates this week, we look at how India will elect its next President.
As the Head of the State, the President is a key part of Parliament. The President calls the two Houses of Parliament into session on the advice of the Council of Ministers. A Bill passed by the Lok Sabha and Rajya Sabha does not become a law unless assented to by the President. Further, when Parliament is not in session, the President holds the power to sign a law with immediate effect through an Ordinance.
Who elects the President?
The manner of election of the President is provided in Article 55 of the Constitution. Members of Parliament and Members of Legislative Assemblies (MPs and MLAs) including elected representatives from the Union Territories (UTs) of Delhi and Puducherry form the electoral college, which elects the President. At least 50 elected representatives must propose a candidate, who must then be seconded by 50 other electors to run for the President's office. Members of Legislative Councils and the 12 nominated members of Rajya Sabha do not participate in the voting process.
The history behind having proposers and seconders To discourage the practice, candidates had to secure at least 10 proposers and seconders each to contest the elections from the 1974 election onwards. A compulsory security deposit of Rs 2,500 was also introduced. The changes were brought in through an amendment to the Presidential and Vice-Presidential Act, 1952. In 1997, the Act was further amended to increase the security deposit to Rs 15,000 and the minimum number of proposers and seconders to 50 each. |
How are the votes calculated?
The Presidential election uses a special voting to tally the votes. A different voting weightage is assigned to an MP and an MLA. The value of each MLA's vote is determined based on the population of their state and the number of MLAs. For instance, an MLA from UP has a value of 208 while an MLA from Sikkim has 7 (see Table 1). Due to a Constitutional Amendment passed in 2002, the population of the state as per the 1971 census is taken for the calculation.
The value of an MP's vote is the sum of all votes of MLAs across the country divided by the number of elected MPs.
How will the numbers look in 2022?
In the 2017 Presidential elections, electors from 31 states and the UTs of Delhi and Puducherry participated. However, in 2019, with the Jammu and Kashmir (J&K) Reorganization Act, the number of states were reduced to 30. The J&K Assembly was dissolved as per the Act and a new legislature for the UT of J&K is yet to be reconstituted. UTs with legislatures were not originally part of the electoral college for the election of the President. The Constitution was amended in 1992 to specifically include the UTs of Delhi and Puducherry. Note that for MLAs from J&K to participate in future Presidential elections, a similar Constitutional amendment would be required to be passed by Parliament.
Based on the assumption that J&K is not included in the 2022 Presidential election, the total number of votes of MLAs in 2022 elections will have to be adjusted. The 87 Jammu and Kashmir MLAs must be removed from the total number of MLAs of 4,120. Jammu and Kashmir’s contributing vote share of 6,264 must also be reduced from the total vote share of 549,495. Adjusting for these changes, 4,033 MLAs will participate in the 2022 elections and the combined vote share of all MLAs will add up to 543,231.

Note that the value of an MP’s vote is rounded off to the closest whole number. This brings the combined value of the votes of all MPs to 543,200 (700 x 776).
What is the number of votes required to win?
The voting for the Presidential elections is done through the system of single transferable vote. In this system, electors rank the candidates in the order of their preference. The winning candidate must secure more than half of the total value of valid votes to win the election. This is known as the quota.
Assuming that each elector casts his vote and that each vote is valid:
Quota = Total value of MP’s votes + Total value of MLA’s votes + 1

The anti-defection law which disallows MPs from crossing the party line does not apply to the Presidential election. This means that the MPs and MLAs can keep their ballot secret.
The counting of votes takes place in rounds. In Round 1, only the first preference marked on each ballot is counted. If any of the candidates secures the quota at this stage, he or she is declared the winner. If no candidate secures the quota in the first round, then another round of counting takes place. In this round, the votes cast to the candidate who secures the least number of votes in Round 1 are transferred. This means that these votes are now added to the second preference candidate marked on each ballot. This process is repeated till only one candidate remains. Note that it is not compulsory for an elector to mark his preference for all candidates. If no second preference is marked, then the ballots are treated as exhausted ballots in Round 2 and are not counted further.
The fifth Presidential election which elected Mr. VV Giri is the only instance when a candidate did not secure the quota in the first round. The second preference votes were then evaluated and Mr. Giri secured 4,20,077 of the 8,36,337 votes and was declared the President.
